Terms and Conditions for Referral Program

This document presents the terms and conditions of the Exadel External Referral Program, which is carried out in Bulgaria, Poland and Brazil. The aim of the program is to provide a reward to those who refer a successful candidate to Exadel. A “successful candidate” means a candidate who ends up being hired by Exadel and joins the company. The Recommender must be legally located in the same country as the referred Candidate. Before submitting a referral to Exadel, you should ensure that the referred individual has given their prior consent to share their personal data with Exadel for further communication and evaluation. By submitting a referral, you confirm that the person you are referring has given their prior consent to be recommended and is personally known to you (e.g., as a friend or family member). All personal data of participants in this Program shall be processed in accordance with our Privacy Notes.This program is applicable to positions as advertised under the “Scope of the External Referral Program”. For each successful referral—where a referred candidate is hired and meets all applicable conditions - the referral reward amount depends on the level of the position for which the candidate is qualified by Exadel. A Recommender (“Referrer”) is a person who voluntarily participates in the External Referral Program by referring eligible professionals to Exadel. A Candidate (“Referral”) is a person referred by a Recommender who is not a current employee of Exadel and who has provided consent to participate in the External Referral Program. Data controller and Program Owner: Data controller of your personal data and program owner is Exadel.

1. Scope of the External Referral Program

The range of positions at Exadel covered by the External Referral Program includes technical positions only (including Software Engineer, Software Architect, Software Tester Automatic, DevOps Engineer, Data Engineer, Data Science, AI Engineer).

The External Referral Program does not cover non-tech positions (including Software Tester Manual, PMs, BAs).

Exadel may, at its discretion, extend the program to positions other than set out in these Terms and Conditions, e.g. those relating to technological issues for a specific project (e.g. Scrum Master), which will be indicated in the notice of open positions. Any decision in this respect shall rest with Exadel.

The External Referral Program covers candidates starting from Middle-level contributors. The Program does not cover Associate-Level Candidates (intern or junior level).

The determining factors for the award are: the position that the candidate is ultimately hired for and the level of experience established during the recruitment process—regardless of the level of experience originally declared and the position originally applied for.

The Referral Program covers positions regardless of the form of employment associated with them (employment contract, civil law contract).

Referrals are valid for 3 months from the date of submission.

2. Objective

The External Referral Program offers a one-time referral payment to persons unaffiliated with Exadel, to help Exadel attract, hire, and retain the very best talent.

3. Eligibility

Referral awards can be granted to any Recommender who meets the conditions described in this Policy.

The Recommender must be legally located in the same country as the referred Candidate.

Recommenders under the External Referral Program can only be persons not currently employed by Exadel or not cooperating with Exadel on the basis of civil law contracts.

Minors or other persons who do not have full legal capacity cannot be Recommenders.

Staffing/recruiting agencies or recruitment consultants are not eligible to participate in the Program.

Exadel reserves the right to exclude from the program any person who sends the candidate’s data without their knowledge or consent or otherwise violates these Terms and Conditions—and to prohibit such a person from receiving the award.

After your Candidate has successfully passed the probationary period, you will be asked to fill out a questionnaire with your personal data. Personal data is needed for the purpose of creating a personal income tax settlement and making the referral payment. This settlement must be included in your annual tax return. PIT settlement will be delivered before 31 January to the address you provided.

In order to lawfully process the information, including Referrer’s personal data, provided by the Recommender, Exadel also provides the Candidate with the relevant data processing clause (Appendix #1).

4. Non-eligible candidates

You will not be eligible for an external referral payment if the candidate you refer falls under any of the following categories:

  • Self-referral
  • Previously referred candidate
  • Current applicant (within last 3 months)
  • Rejected candidate (within last 6 months)
  • Recent or current contractor, temporary worker, payrollee, or consultant
  • Former Exadel employee
  • Family member of a current Exadel employee
  • Candidates without required qualifications
  • Candidates with a conflict of interest
  • Candidates without legal right to work
  • Candidates who violated Exadel policies

Referral payments will not be made for candidates meeting any of the above criteria.

5. Process to refer candidates

Submission Method: All candidate information must be submitted through the Exadel website.

Required Information:

  • Your name and contact information
  • Candidate’s full name
  • Candidate’s contact information
  • Requisition number(s)

Status Updates: The recruiter will communicate updates via email.

Candidate Data:

  • CV submission required
  • Candidate consent required
  • Unauthorized data submission leads to immediate stop of processing

Multiple Recommendations: Allowed.

6. Payment terms

Exadel will process the referral bonus within 30 days after the referred employee completes the 3-month probation period.

Reward amounts:

  • Bulgaria: 950€ (Middle), 1300€ (Senior), 1500€ (Lead)
  • Poland: 2000 PLN (Middle), 2500 PLN (Senior), 3000 PLN (Lead)
  • Brazil: (not specified)

Eligibility conditions:

  • Candidate acknowledges referral
  • Candidate is hired
  • Candidate not previously referred
  • Candidate not rejected in last 6 months
  • Candidate did not apply independently
  • Candidate is still employed at payout time

The recommender must complete the required form within 30 days.

The referral award is granted after 3 months of continuous work.

If the referred person is absent for at least 10 working days, the probation period is extended.

Payment will be transferred within 30 days after meeting conditions.

The recommender must provide bank details.

The recommender is responsible for tax settlement.

All payments are subject to local taxes.

Data controllers:

  • Poland: Exadel Poland Sp. z o.o., Warszawa
  • Bulgaria: Exadel Bulgaria JSC, Sofia
  • Brazil: Exadel Financial Services Brasil Ltda

Processor: Exadel Inc., Walnut Creek, CA, USA.

Purpose: processing related to recruitment (GDPR art. 6(1)(b)).
